(African Stand) — The government of Malawi, through the Ministry of Agriculture, was on August 31 2020 put into effect the Cannabis Regulation Act (CRA), bill number 6 of 2020.

In a gazette notice that Our Publication online, has seen and signed by Minister of Agriculture Lobin Lowe indicates that the CRA became into enforcement on 31 August 2020.

“In exercise of the power conferred by Section 1 of Cannabis Regulation Act, 2020 I Lobin Clarke Lowe, Minister of Agriculture, appoint the 31st August 2020 as the day of which the Act shall come into operation,” reads the gazette notice.

The CRA will among others, allow authorized people to cultivate, process, and production of marijuana for industrial purposes.

“The Act establishes Cannabis Regulatory Authority (CRA) responsible for licensing and regulating medicinal and Industrial hemp programmes. CRA will grant a license to: cultivate, process, store, sell, export and distribute cannabis,” reads part of the Act.

The Act further requires that the exportation of the processed Cannabis will require a license from the Cannabis Authority. The Authority shall also grant a license for the scientific research programme and also security for processing, cultivation, and storing of the Cannabis.

The Act also bars children from taking part in the Cannabis cultivation. And that the destruction of the Cannabis vegetation shall be done in the presence of police.

The Act further gives punishment to anyone who contravenes the Act.

The Act reads: “cultivating, processing, or distributing Cannabis in contravention of the law will be an offence liable to a fine of K50 million and to imprisonment for 25 years. Refusing to produce documentation, making false statements will be an offence liable to a fine of K10 million and imprisonment for five years.”

The Government has also put into effect the Plant Bleeder’s Right Act. The Cannabis Regulatory Authority (CRA) was brought to Parliament as a bill in February this year during the previous administration of President Peter Mutharika.
